Acceptance of terms

These Terms and Conditions (the Terms) are a binding agreement between you and Bevel Theme (wpbevel.com) (Bevel, we, us, or our). By downloading, installing, purchasing, or using the theme, plugin, templates, website, or any related service (together, the Services), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Definitions

  • Software means the Bevel WordPress theme, the companion plugin, and any code we provide.
  • Account means the account you create on wpbevel.com to manage plans, licenses, and updates.
  • Plan means a paid subscription that provides automatic updates and support for a defined period and number of sites.
  • Site means a WordPress installation on which you use the Software.

License to use Bevel

The Software is free to install and use in full, with every feature available, on any number of your sites, with or without a connected Account. A paid Plan is not required to use the Software; it provides automatic updates and support.

The Software is open-source software licensed under the GNU General Public License (GPL). Your rights in the Software code are governed by the GPL. These Terms govern the services we layer on top, including your Account, updates, support, and access to wpbevel.com. Nothing in these Terms limits the rights the GPL grants you in the Software itself.

You may use the Software to build sites for yourself and for clients. You may not remove or alter licensing notices in a way that misrepresents the origin of the Software, and you may not resell access to our update or support services as if they were your own.

Accounts

To buy a Plan or receive automatic updates you must create an Account and provide accurate information. You are responsible for keeping your credentials secure and for all activity under your Account. Notify us promptly at support@wpbevel.com if you suspect unauthorized use. You must be at least 16 years old, or the age of majority in your jurisdiction, to hold an Account.

Pricing and billing

  • Prices. Plan prices are shown on our pricing page and may change. Changes do not affect the current term of an active Plan.
  • Payment. Paid Plans are billed in advance through our payment processor. By purchasing, you authorize us to charge your chosen payment method for the Plan and any applicable taxes.
  • Renewals. Plans renew automatically at the end of each term at the then-current price unless you cancel before the renewal date. You can cancel automatic renewal at any time from your Account.
  • Taxes. Prices may exclude taxes such as VAT or sales tax, which we add where required by law.

Refund policy

We want you to be satisfied. If a paid Plan does not work as described, you may request a refund within 14 days of your original purchase by writing to support@wpbevel.com. Refunds are provided at our discretion for first-time purchases and generally do not apply to renewals, to purchases older than 14 days, or where the Services have been used in a way that breaches these Terms. Because the Software is GPL and can be kept after a refund, refunds also cover discontinuing your access to updates and support.

Updates and support

An active Plan provides access to automatic updates and to support for the sites and period covered by that Plan. We aim to reply to support requests within one business day but do not guarantee a specific response or resolution time. We may end support for older versions of the Software and recommend keeping it up to date for security and compatibility. If your Plan lapses, the Software keeps working, but you will no longer receive automatic updates or support until you renew.

Acceptable use

When using the Services you agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to our systems, other accounts, or our update infrastructure.
  • Interfere with or disrupt the Services, including by transmitting malware or overloading our servers.
  • Misrepresent your affiliation with Bevel or use our name, logo, or brand without permission.
  • Abuse the support channel or the refund process.

Intellectual property

Except for the Software code that is licensed under the GPL, all content on wpbevel.com, including the Bevel name, logo, brand, written copy, images, and designs, is owned by Bevel or its licensors and is protected by intellectual property laws. You may not use our trademarks or branded materials without our prior written consent. Starter templates and demo content are provided for use in sites you build, subject to any third-party asset licenses noted with them.

Third-party components

The Software works alongside third-party software, including the WordPress platform and page builders and their extensions. Your use of those components is governed by their own licenses and terms. We are not responsible for third-party software, and the availability of features that depend on third-party components may change if those components change.

Disclaimer of warranties

The Services are provided as is and as available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or fully secure, or that they will meet your specific requirements. You are responsible for maintaining backups of your sites.

Limitation of liability

To the maximum extent permitted by law, Bevel and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the Plan during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless Bevel and its team from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising from your use of the Services, your content, the sites you build, or your breach of these Terms.

Termination

You may stop using the Services and close your Account at any time. We may suspend or terminate your access to the paid Services, including updates and support, if you breach these Terms, fail to pay, or use the Services in a way that harms us or others. The GPL rights you have in the Software already in your possession survive termination. Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, and indemnification, will continue to apply.

Changes to these terms

We may update these Terms from time to time. When we make material changes we will update the date at the top of this page and, where appropriate, notify you through the Services or by email. Your continued use of the Services after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the jurisdiction in which Bevel operates, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, unless applicable consumer law gives you the right to bring proceedings elsewhere.
